Under Section 107 of the Copyright Act 1976, allowance is made for “fair use” for purposes such as criticism, comment, news reporting, teaching, scholarship, and research. Fair use is a use permitted by copyright statute that might otherwise be infringing. Non-profit, educational or personal use tips the balance in favor of fair use. The Center for Media and Social Impact (CMSI) has adopted a set of best practices as it relates to the copyright doctrine of fair use when making online videos. Specifically, any reproduction, re-posting, or quoting in order to memorialize, preserve, or rescue an experience, an event, or a cultural phenomenon is an acceptable use of copyrighted material under the fair use clause.
